It is understandable that RD wished to cancel the contract within the 5-day penalty-free period, but a more thoughtful approach would have been to consult with the agent before taking any action. A discussion about the challenges presented by Diáspora and potential solutions may have allowed for a more positive outcome, such as modifying the booking or finding a workaround. RD's initial response to the agent, GW, included an invitation for further discussion, but it placed a stronger emphasis on canceling the contract rather than exploring options first. This inadvertently made cancellation appear as the most urgent course of action, rather than initiating a more constructive dialogue. Notes Comments This situation highlights the advice shared by JH: “Every other agency/band/fixer I work with usually asks for a reply to confirm acceptance of the terms of the contract. Unfortunately, you can’t imply consent in contract law like that.” In this case, RD was not instructed to sign the contract, but rather told that the contract would automatically become legally binding after 5 days. This approach was unfamiliar to RD, and the method used by AN raised questions about its standard practices. Additionally, this decision backfired when JM shared details with JE, which ultimately resulted in Diáspora being dropped from the agency without prior notice. This underscores the importance of trusting the right agents and the potential consequences of premature decisions. Not all agents are trustworthy, and this experience illustrates the risks of acting too hastily without discussing the situation thoroughly.
